What is a Conditional Use Permit (CUP)?

The Norfolk Zoning Ordinance identifies different types of land uses and determines if they are permitted ‘by right’ or by Conditional Use Permit.

Determining Appropriate Land Use by Right or CUP

By Right

A use that is appropriate in a particular zoning district.

CUP

A use that may be appropriate in the zoning district, but because of its nature, extent, and external effects, requires special consideration of its location, design, and methods of operation before it can be deemed appropriate in the district and compatible with its surroundings. 

Examples: 

By Right

  • Single-Family Home in a Residential District
  • Hair Salon in a Commercial District
  • Contractors Office in an Industrial District

CUP

  • Day Care Center in a Residential District
  • Automobile Repair in a Commercial District
  • Junkyard in an Industrial District

Common CUPs

  • Short Term Rentals
  • Auto related uses (car sales/repair)
  • Drive-throughs
  • Tattoo Parlor

The CUP Process

  1. Preapplication Meeting
  2. Meet with appropriate Civic League and/or Business Association
  3. Submit complete application
  4. Staff/CPC site visit posting of property
  5. Planning Commission Hearing
  6. City Council Public Hearing
